A plaintiff had booked a flight from Hamburg via Paris to Mexico City. The water temperatures in Europe have changed little compared to the previous week. Madeira, Tunis, Valencia and Oslo have increased by one degree, the IJsselmeer makes the biggest jump in temperature from 10 to 12 degrees Celsius. The currently strict rules on liquids in hand luggage on flights will be relaxed somewhat. As of January 31, 2014, an EU regulation allows passengers to take liquids that they have bought at airports outside the EU on board when transferring within the EU. If a cruise ship deviates from the planned route and does not call at a port, this represents a travel deficiency. The passengers are entitled to a reduction in the travel price for the days in question. However, they do not have any further claims, such as compensation for wasted vacation time. In the negotiated case, a seven-day Mediterranean cruise was to run from Antalya via Limassol in Cyprus, Port Said in Egypt, Heraklion in Greece and Marmaris in Turkey. Due to unrest in Egypt, the shipping company decided not to call at Port Said. Ashdod in Israel was used as an alternative port. The plaintiffs argued in court that Port Said was a decisive criterion for them on the trip. Therefore, they demanded a reduction in the price of the trip by 60 percent and compensation for pain and suffering of 400 euros. The shipping company paid the plaintiffs only 200 euros.
The district court approved the shipping company. Deviating from an itinerary is a deficiency, but not so massive that it affects the entire trip. All other parts of the trip were carried out as planned. In addition, Ashdod is an attractive alternative destination.
Wiesbaden (dpa / tmn) – A tour guide is important if there are suddenly problems at the holiday destination. If it was promised to holidaymakers, it must also be available. Negotiating with management on your own is not a good idea.
If a tour guide is promised in the catalog, they must also be available. Only if neither the tour guide on site nor the operator react to a notification of defects, the travelers are allowed to remedy the situation themselves. This could mean, for example, that you ask the hotelier for another room in the booked category.
